The strongest starting point is a documented comparison of the property at move-in and move-out. A deposit dispute should be approached as an evidence exercise: what was paid, what condition was recorded and what deduction is actually being claimed?

Understand the legal starting point

Article 20 of Dubai Law No. 26 of 2007 requires the landlord to refund the security deposit, or its remaining balance, when the lease expires. Article 21 excludes ordinary wear and tear and damage beyond the tenant’s control from the obligation to return the property in its original condition. Read these provisions with the tenancy contract and applicable amendments. [1]

This guide concerns Dubai tenancies within the applicable rental framework. Properties subject to a separate legal or dispute-resolution regime require individual assessment.

Assess deductions before accepting them

Ask for an itemised explanation showing each alleged defect, the proposed cost and supporting photographs, quotations or invoices. Compare these with the move-in inventory and earlier maintenance reports. A request to charge for painting or replacing an appliance should not be accepted simply because the landlord lists it at checkout. Its basis, the condition of the item and responsibility for the problem all need consideration.

Keep other alleged debts, such as unpaid bills or rent, clearly identified. Their treatment depends on the contract and applicable law; they should not obscure the calculation of the deposit balance.

Build a clear record and request repayment

Keep the signed lease, Ejari record, deposit receipt, dated photographs, maintenance correspondence and proof of returning keys and access cards. Request a joint inspection and written handover record. Do not sign a statement accepting deductions or confirming full settlement unless it reflects your agreement.

Send a written repayment request identifying the property, tenancy dates, deposit paid and amount sought. Ask for evidence of disputed deductions and propose a reasonable response date. Your proposed date is a practical request, not a universal statutory refund deadline.

Escalate through the appropriate channel

If written discussions do not resolve the issue, assess whether to bring a claim before Dubai’s Rental Disputes Center. Confirm jurisdiction and the current service requirements before filing. The RDC’s first-instance rental service lists the latest lease or Ejari, identity evidence and supporting documents; submissions must be in Arabic or accompanied by a legal Arabic translation. Check the current fees and document list directly. [2]

Present a simple chronology and a transparent calculation: deposit paid, deductions accepted, deductions challenged and balance claimed. A realistic assessment of evidence and costs can help you decide whether settlement or formal proceedings are appropriate.

How we can help

Dr. Hamad Alustath Advocates and Legal Consultants assists tenants and landlords with reviewing tenancy terms, assessing disputed deductions, preparing correspondence and advising on rental dispute resolution.
